WHAT HAS CBA/ABATE
DONE FOR YOU LATELY:
CBA/ABATE of NC maintains a constant presence in the General Assembly (1) to protect bikers from the politicians
and bureaucrats who try to impose well meant but ill-advised, unnecessary new restrictions on people who ride motorcycles
and (2) to advance the interests of the motorcycling public through the introduction of legislation and participation in the
legislative process.
Here’s a sample of what CBA/ABATE of NC is doing in the 2011 Session of the General Assembly to protect the rights
of bikers:

480. LET THOSE WHO RIDE DECIDE – This bill, actively supported by CBA/ABATE of NC, exempts motorcycle
operators and passengers who are 18 years of age or older from the mandatory helmet law. The bill has passed first reading
in the Senate and resides in the Committee on Rules.
H 113. MOTORCYCLE SAFETY ACT – This bill stipulates that a failure
to provide right of way that causes a motorcyclist to change travel lanes or leave its travel lane is a Class 2 misdemeanor
resulting in a fine of not less than $200.00 and a Class 1 misdemeanor and a fine of not less than $500.00 if the violation
results in property damage or personal injury to the motorcycle operator or passenger. This bill was introduced at the
request of and is actively supported by CBA/ABATE of NC. The bill passed the House and was given a favorable report
by the Senate Transportation committee. It is now awaiting action by the House Finance Committee.
H 166. PURPLE HEART MOTORCYCLE SPECIAL
PLATES – This legislation authorizes DMV to develop a special motorcycle license plate for Purple Heart
recipients. This bill received a favorable report by the House Committee on Transportation and now awaits action by
the House Finance Committee.
H 205. MOTORCYCLE AWARENESS MONTH (H 105) – This bill, authored and actively supported
by CBA/ABATE of NC, designates the month of May as Motorcycle Awareness Month. The bill has passed the House, and now
awaits action in the Senate Rules Committee.
H 381. CHECKING STATION PATTERN SELECTION – This bill prevents law enforcement
agencies from establishing patterns for vehicle stops at checking stations based on a particular type of vehicle, thus putting
a stop to “motorcycle only” checkpoints. The bill passed the House and will next be considered in the Senate
Judiciary II Committee.
H 392. MODIFY MOTORCYCLE HELMET REQUIREMENTS – This bill repeals the requirement that a person
who is eighteen years old or older wear a helmet while operating a motorcycle on a public street or highway or public vehicular
area. The bill is actively supported by CBA/ABATE of NC. It passed first reading in the House and currently awaits
action in the House Committee on Transportation.
